Penny, who has pleaded not guilty to second-degree manslaughter, was told to return back to court in March. On May 1, Penny was deemed a hero by subway passengers after he put Jordan Neely in a choke hold which ultimately killed him. "Mr. Penny cared for people. That’s what he did. That is his crime," a 'woman of color' who was a passenger said. "It was self-defense, and I believe in my heart that he saved a lot of people that day that could have gotten hurt."
