Apparently, ill-prepared ang abogado ni sara. Sa mga litigators, kung ang isang witness ay ipi-present as an expert, we make sure na alam na namin ang credentials ng witness na yan. Having known in advance, we know how to attack the testimony of such witness. Unlike nung panahon, ang mga judges ngayon are taking an active part in examining a witness. Just like what kiko pangilinan did. The defense lawyers should know better. Televised pa naman ang proceedings.

When an actor plays a dancer on-screen, especially a classical dancer, expectations are huge. I can think of two male actors who were great in this regard. Kamal Hassan was a trained dancer and pulled off a milestone like Sagara Sangamam in the 1980s. But a good actor ( though an untrained dancer) can get basic training and convey the idea before the camera. An actor has to just make you believe that he is a dancer. He cannot do with a year's training what a dancer does after a decade's regimen. Look at this dance from Kamaladalam. Mohanlal isn't a dancer but he has understood dance enough to enact on-screen and his understanding is conveyed in the clip shared by Revolutionary Monk He learnt the basics of the dance to "act" like a dancer from Nattuvan Paramasivam. Mohanlal upped the act a few years later as the ageing Kathakali artiste in Vanaprastham, for which he trained under the legendary Kalamandalam Gopi. You need to be convincing on screen. That's enough for an actor. Don't fail even with the basics and the choreographer and director have the responsibility to ensure they don't look like a parody on the big screen.

🚨BREAKING: ICE agents detained a man because he refused to answer their questions about his immigration status… while he was legally observing and filming them questioning someone ELSE. This man was standing at the front of a business, filming the encounter, when an agent walked over and started questioning HIM. In the video, an ICE agent asks where he’s from. He says Ecuador. The agent asks if he has a visa. The man responds that he has lived in the United States for 45 YEARS. The agent then asks what kind of documentation he has. The man responds, “Do I have to tell you all that?” And the ICE agent says, “No, I’m just asking you.” Okay… so he’s “just asking.” Then, the person filming points out that ICE came into their parking lot, so he’s just filming. And the agent walks away. Then EVERYTHING changes. Two agents walk back toward him, into the business, and tell the person filming, “Come here.” Followed by… “You said you are from Ecuador? You are being detained.” And it appears they then grab him. You can hear the man immediately saying, “I got to get my passport.” Then the video cuts. So, let’s break this down… Telling an ICE agent that you are from Ecuador is not, by itself, reasonable suspicion that you are undocumented. Being born in another country does not mean you are in this country illegally. And refusing to answer an agent’s questions, about your immigration status, doesn’t automatically give them the right to detain you. The Fourth Amendment protects people from unreasonable seizures. And when the government stops you, and tells you, “you are being detained,” that is a seizure. There is a HUGE difference between an agent walking up and asking questions, and an agent taking away your freedom. And notice what the agent says BEFORE the detention… “No, I’m just asking you.” So, what changed? The man said he was from Ecuador. He questioned whether he had to answer his questions. And suddenly, he’s being detained. And THIS is exactly why these encounters need to be filmed. Because if an agent can approach a random bystander because he’s filming, start questioning him about his immigration status, and then turn that encounter into a detention after he refuses to answer, we need cameras on all of these interactions. Not just to see what happens when someone is detained… but to see exactly how the agents got there.

UgandaVsMollyKatanga Senior Forensic Pathologist calls the possibility that Mr Henry Katanga was shot and killed by his wife Molly Katanga, “extremely slim and highly unlikely”. He said the case before Justice Rosette Comfort Kania is not a homicide but a homicide-suicide where Mr Henry Katanga beat his wife, thought she was dead then sat or stood on the bed and shot himself. He lambasted the postmortem report presented by the state to back up their case as a “very dangerous postmortem report that couldn’t have passed peer review” in a serious entity. Dr Sylvester Onzivua was the first defense witness in this trial. He holds a Degree in Medicine and Surgery, from Makerere University (1993), a Masters of Medicine in Pathology (2003), a Post Graduate Diploma in Forensic medicine from the Colleges of Medicine of South Africa (2005). He’s also trained in Forensic Anthropology from Durban. He worked with Mulago Hospital, attached to the Department of Pathology of Makerere University and part of his deployment was in the City Mortuary where he was the Head of City Mortuary. He worked there from 2005 up to 2013. He said he has testified in numerous cases, mostly for the prosecution, including in the military courts. In a session whose start was marked by early heated exchanges between defense attorney Elison Karuhanga and Chief State Attorney Jonathan Muwaganya, Dr Onzivua took on the mantle of courtroom forensic pathology Prof, basically reliving a teaching role he continues to play in real life at Makerere University, even after his retirement. Early court proceedings were anything but smooth, with the Judge calling both sets of lawyers to her chambers for more than 2 hours because the state was adamant that Dr Onzivua shouldn’t use the postmortem report on court file but should instead use copies availed to him by the defense. On resumption and with a 50 slide PowerPoint presentation, Dr Onzivua took Justice Kania through the science of bullets and bullet injuries. He told her how to tell a bullet entry wound from an exit wound. He then used images of the late Henry Katanga, taken during postmortem, to show that the pathologists who conducted that postmortem wrote an erroneous report that misled the court to think the bullet that killed Mr Katanga went from left to right as opposed to what he said was a scientifically incontrovertible conclusion that the bullet direction was right to left. This point is very key because when Justice Kania put Mrs Katanga to her defense, she relied in part on prosecution evidence that claimed that Mr Katanga was shot on the left side of his head and since he was right handed, this would be very difficult. Dr Onzivua scoffed at that and using a combination of human props and postmortem images, he showed that indeed the state had it wrong; that it was scientifically wrong to conclude as they did. He pointed to the absence of tattooing, lacerations on the hole on the left side of Mr Katanga’s head and wondered why the state pathologists concluded that it was an entry hole despite showing all characteristics of an exit hole.
