He makes an interesting argument that Flock cameras violate the 2nd Amendment because they track people going to gun stores, gun ranges, and so they enable the Federal government (we know they have access to Flock data) to make a database of gun owners. As we know, if the...

Actually Flock cameras violate the 4th Amendment Unreasonable search & seizure

@JesslovesMJK Flock cameras are violating the 4th amendment. They think they’re getting around it because Flock is a private company. But this can be challenged in court because they get government subsidies and provide the government with information they acquire.

@JesslovesMJK That last part especially. If it were illegal for them to go out and collect the data themselves, I'm not sure how they think it's ok to pay someone to do it for them. It's the same thing.

They don't need Flock cameras, they already broke the law and created a database:

Flock can tell them what church, what synagogue, what mosque, what political campaign, what dr, what self help group, which school board meeting etc. But Flock can’t prevent a crime - we already have powerful cameras on public & private properties alike & still the same crime

Without "cause" collection of data is a violation of the 4A. But we need Judges to act for us, not he Bureaucrats. And there should be penalties for abuse.

The 2nd amendment is Not to be infringed. Marbury v Madison 1803 "anything found to be repugnant to the constitution shall be void. That means they can't, if the Supreme Court is not compromised. If so,We the People will have to say No, it is our duty.

Would you trust your worst political enemy with a searchable record of trips to gun stores, churches, and protests? That's the test. Privacy shouldn't depend on your side winning the next election.

The most important thing he stated, by far, is not the flock camera suit, but the correct observation on how the Police-State agenda is progressing in this country... I hope he does write that in the suit, politicians are trying to use law enforcement as willing protection goons.

At some point they will make a national move to “grab” all guns from lawful owners and it will be in the context of massive round ups of all citizens deemed “problems” enroute to global governance.

If you have a pending lawsuit, you don't talk publicly about pending lawsuit.

That might be more so for criminal cases? I know people make announcements about civil suits all the time. I'm not an expert, though.

It was more than an announcement, stating your argument in front of the defendants outside of court seems like a bad idea. You are giving them your playbook before the game, and any communication specific to the case should probably go to their legal council.

(2) It is unclear whether Flock cameras violate Second Amendment. The problem is that the constitutional question of whether the government may mandate a gun registry or create one indirectly has not been fully litigated or definitively settled by the U.S. Supreme Court.

#WATCH | Delhi | Rajya Sabha MP and Senior Advocate who is representing TMC, Kapil Sibal says, "...This case is an exception, and that is why I have come here. Because the mainstream media is reporting on the court case in a different way, they are reporting that our petition has been dismissed. This is wrong in itself... The TMC's claim in the High Court was that this circular is wrong... the High Court said that this circular is correct. When we came to the Supreme Court, we decided that we would not challenge the circular. But we will request the Supreme Court to implement it... The circular states that the EC has received information from many places that there are going to be some problems in every booth during the election... This is why the EC has decided that every booth will have a nominee from the central government..." He adds, "We stated in the Supreme Court that their own circular says if you want to keep a nominee from the central government, then do so, but keep a nominee from the state government as well. Randomise that as well... The Supreme Court noted that we were challenging the circular there, but we clarified that we are not challenging the circular anymore. We are saying that it should be implemented... Now we have hope. The Supreme Court said, and this is an order, that the EC will follow the circular issued by them both in letter and spirit... What is written is that there will be a nominee from the state government and a nominee from the central government... The mainstream media that is running it is saying that our petition has been dismissed. This is completely wrong... give them the right information..."

The Supreme Court may take down Flock Cameras and the entire surveillance state being built because it violates the 4th Amendment The Supreme Court just issued a major ruling that strengthens the Fourth Amendment protections that Flock has been exploiting “On the heels of the recent Supreme Court ruling on geofencing and how that violates the Fourth Amendment, a US district judge has now ruled that tower dump warrants also violates the Fourth Amendment. As a reminder, the Supreme Court ruled that your location data is protected by the Fourth Amendment. That means the police cannot just pull your phone information via GPS without a warrant because it's considered a search, citing Carpenter v. United States This Mississippi judge is essentially calling out police for using a loophole to still grab similar data from people and is trying to close it by saying that these tower dump warrants are too general because it still grabs your location data, which is therefore subject to probable cause and more specific warrants because it's considered a search which is protected by the Fourth Amendment. The Supreme Court's ruling could potentially be setting Flock up for violating the same thing because Flock had previously leaned on Carpenter v. United States to claim that they are constitutionally protected and allowed to surveil and store people's data the way that they do. But that was before the Supreme Court's recent ruling.” “As much as there seems to be an uptick in surveillance systems and the digital panopticon being built around us, it also seems like there is a growing opposition towards all of this, and it seems to be quite effective” Flock even on their own website sites Carpenter v. United States as justification to why they are constitutionally allowed to operate and collected their digital data But now the Supreme Court is expanding digital data protection rights Ban Flock Cameras from America

I have listened to the debate on Constitutional Amendment Bill No. 3 between legal scholar Dr Justice Mavedzenge and political scientist Prof Jonathan Moyo today on Twitter. Without any doubt, Dr Justice Mavedzenge explained, clarified, and made ordinary people understand the issues, and more importantly, in my humble view, he won the debate on whether there is need for Constitutional Amendment Bill No. 3 to be subjected to a referendum or not. Anything done for the people, as Prof Jonathan Moyo says these monumental amendments are, should be subjected to the people. The Constitution is not ambiguous on this. It is clear that term limits should be subjected to a referendum for any change to be done legally. Under Section 328 of the Constitution of Zimbabwe, any amendment that seeks to extend the length of time a President may hold office, or to remove or alter term limits in a way that benefits an incumbent, cannot apply to the sitting President and must be subjected to constitutional safeguards. You cannot claim to be doing something for the people and yet deny those same people the right to have a say. Prof Jonathan Moyo has a right to his views, but those views must be subjected to the law for the amendments to be implemented legally, and based on what I have read in our Constitution, his views are not aligned with the law. And I am not making this up. It is in the Constitution. Even veteran Zimbabwean lawyer and former ZANUPF legal secretary, Patrick Chinamasa, has said so. In this video, he explains in front of President Mnangagwa that what they are attempting to do today, which Prof Jonathan Moyo argues does not require a referendum, would in fact require two referendums. One to remove or alter presidential term limits from five to seven years, and another to extend the sitting president’s tenure to 2030. This position was declared, and not contradicted, at a ZANUPF conference in Bulawayo. What the broader legal fraternity in Zimbabwe is saying, save for a few lawyers who have since revised their positions and now echo the same view, is that the Constitution is explicit on these prescripts. Anything else is political propaganda to win hearts and minds. The problem with propaganda is that it cannot be anchored in constitutional provisions. It rests on opinion. In this instance, however, we are not expressing opinions. We are stating what is contained in the Constitution and what ZANUPF itself has previously acknowledged. You can decide today that you want a 20-year presidential term. That is your right to hold that view, but you must subject that proposition to the law. If you believe in it, take it to the citizens in the manner prescribed by the Constitution. You cannot decide, through opinion or political argument, whether a referendum is required or not. That question is not settled by what anyone thinks. It is settled by what the law says. If the Constitution requires a referendum, then you must subject yourself to it. That is how constitutional democracy works. We know that the judiciary in Zimbabwe is captured. We know how they are going to rule, but the whole world knows the truth, that if they rule in favour of these amendments going ahead without a referendum, they are simply a captured judiciary without the respect that is required for anyone holding such an important office, and history will remember them as such.

Tulsa's Police Chief, Wendell Franklin, recently expressed his support for a 9/11-style response to gun violence and suggested that people may need to sacrifice their freedoms in exchange for gun control measures & safety. In an interview posted by NPR, Franklin criticized constitutional carry, advocated for stricter regulations on so-called "ghost guns," and hinted at the implementation of waiting periods for purchasing commonly owned firearms like the AR-15. Franklin, emphasizing the expertise of law enforcement in protecting the nation, stated, "We are the subject matter experts at protecting America, right? Protecting our cities. And, you know, we should be utilizing that in that manner." He believes that if there are better methods of safeguarding the community, they should be explored even though the supreme court ruled that they are not responsible for your individual safety. He stated, "Ultimately, I’m a Second Amendment guy... But I’m okay giving up some of that freedom, right? We had to give up some of that freedom after 9/11. I’m okay with waiting three days, five days, or whatever to get my firearm if I go out and purchase another firearm. So I’m okay with a pause to allow for weapons to be purchased and allow the government and the gun companies to look at the background and do a thorough check before that gun goes to someone." To justify his stance, Franklin likened giving up freedom for gun control to the process of adapting to seatbelt laws when they were initially introduced. He explained, "You know, we put seatbelt laws in place...probably in the 1980s, I think. And we mandated that everyone starts wearing a seatbelt, and it took some time for people to grab hold of that. But if you look today, it is an automatic thing that people put on their seatbelt when they get into a vehicle. You feel uncomfortable not wearing that seatbelt. I think again, we give something up to get safety for something safe. I think that’s where we are today. We are going to have to give up some things. And I think there are some things that we can give up for a safer community." #2ANews
