I wasn’t surprised when Clancy wasn’t convicted, because this isn’t the first occurrence, and it won’t be the last. Courts in the United States have accepted insanity (not criminally responsible) defenses in cases where a parent kills their child during a postpartum psychotic episode at other times. As the... prosecution, I would have asked Lindsay if she was familiar with the Yates case, and if her defense had advised her about it. Yates was first convicted, but after appeal, she was found not guilty by reason of insanity in 2006. She has remained in a Texas psychiatric hospital since. A finding of insanity doesn’t make the outcome any less horrific. It just means the court is deciding whether someone who had completely lost touch with reality can be held criminally responsible in the same way.

I don’t believe in sudden insanity.

@CherokeeOwl Again, not true. If she is being advised by competent counsel they will simply instruct her not to answer any questions. You are confusing Civil with Criminal liabilities.

@CherokeeOwl Deposition occurs regardless of whether the defendant chooses to answer or not. I know the difference between civil and criminal. In criminal, the defendant may refer all answers to his attorney. That doesn’t stop a deposition from being scheduled.

@CherokeeOwl It does as a general rule prevent them from being needlessly scheduled unless when the prosecutor knows or is informed of the certain results of scheduling one. They do not waste their time or the State’s money on fruitless exercises in futility.

I don’t disagree they are theoretically possible but once Attorney/Client Privilege is invoked - they rarely occur unless the Prosecution (and usually the Defense as well) believes that the Defendant will be swayed to reach a plea bargain where the case is overwhelming and the Defendant is being recalcitrant despite his Counsel’s advice and both want to show him/her sufficient evidence to convince him/her to accept a plea (ie take death penalty off the table in return for guilty plea).

Woman are 50% likely to get off on insanity defense. Men are 7% likely to get off with insanity defense.
