In the video, ICE agents were leaving the Broadview ICE facility when one agent stopped, aimed a pepper ball gun at a protester, who was standing on a public sidewalk… not blocking the vehicle, or obstructing anything… and shot them in the abdomen. Then, they just kept driving. The protester had to be treated at the scene before being transported to the hospital. Now, imagine if an ordinary U.S. citizen pulled up, shot someone with a pepper ball gun, and drove away... Police would be looking for them. There would be arrests, charges, and headlines calling it what it was… Assault. But when it’s a federal agent? And this isn’t even the first time something like this has happened. We’ve watched ICE agents assault protesters with pepper spray, from their vehicles, and keep driving. We’ve watched people exercising their constitutional rights become targets. We’ve watched it happen over and over again. So, where is the accountability? Peacefully protesting, on a public sidewalk, is protected by the First Amendment. Using force against someone, who poses no immediate threat, is a direct violation of that right. And every single person in this country should be demanding answers. Because if federal agents can shoot a peaceful protester, drive away, and face no consequences… Then we no longer have equal justice under the law. 🚨BREAKING: ICE agents were caught, on video, recklessly pointing their GUNS at a CHILD, and multiple other unarmed U.S. citizens… who were nowhere near them… while demanding a legal resident prove his immigration status, in Immokalee, Florida. And this all happened in a busy gas station parking lot… In the video, a person is recording while walking toward the sidewalk… When suddenly, an ICE agent draws his firearm, turns around, and points his gun directly at the unarmed U.S. citizen. And just to be clear… No one was attacking him, rushing toward him, or even armed with any sort of weapon. In fact, no one was even close enough to pose an immediate physical threat. Then, the agent, with his gun still drawn, orders a car to move. As it backs up, he recklessly sweeps his loaded firearm across multiple unarmed people… including a MINOR… who are standing on a public sidewalk, legally record from a distance. The person filming keeps asking… “What’s the threat?” Because the video clearly doesn’t show one. Moments later, the same agent points his gun at the person filming, AGAIN. Then, a shirtless man walks around the vehicle to see what’s happening, and the agent immediately points the gun at him, too. At this point, a second ICE agent is seen, standing on the side of the car, with HIS gun drawn, too. And after all of that… The man, they were demanding papers from, walks away because he wasn’t undocumented. And the ICE agents get into their car and leave. Federal officers are trained to draw their firearms only when they reasonably believe there is an imminent threat of death, or serious bodily harm. Every time a loaded firearm is pointed at someone, there is a risk of a tragic mistake… especially in a public place where innocent bystanders could be caught in the middle. And once again… recording federal agents, from a public place, is protected by the First Amendment, so long as you are not interfering with their duties. And no one was interfering… or even near them. So, what exactly justified having multiple firearms drawn, and pointed at unarmed people, in a crowded gas station parking lot? This wasn’t just dangerous for the people filming… It was dangerous for everyone in that parking lot. Yesterday, ICE reportedly told police that a man “weaponized” his vehicle by “ramming” into an ICE sedan, forcing an agent to fire his gun during an operation in Harrisburg, Pennsylvania. Except… that’s not what the video shows. In the video, an ICE agent rushes the driver’s window with his gun drawn. The agent recklessly waves his gun around, and appears to order the driver to roll down the window. That’s an extreme use of force from the very beginning. Another agent approaches the car, and moments later, they violently smash the driver’s window. And notice how the driver doesn’t try to flee until ICE violently escalates everything. He drives around the ICE vehicle, makes it into the street… not hitting a single ICE agent, or vehicle. Then, AFTER the car is already past every agent, and driving away, an ICE agent opens fire. The law is pretty clear… officers may only use deadly force, against a fleeing person, if they have probable cause to believe that person poses an immediate threat of death, or serious physical injury to the officer, or others. So, where was the immediate threat? The car had already passed the agents… and was driving AWAY. ICE also claimed Lara-Hernandez had a criminal history of assault, and that this was a targeted enforcement operation. Yet, publicly available court records reportedly do not show any active warrants. Federal agents don’t get to point guns at people without legal justification. They don’t get to fire at a vehicle after the immediate threat has passed. And they don’t get to lie to police about what happened. So, when are we going to start holding these agents accountable?
