Luckily a 37 member senate is Unconstitutional. Without 38, everything is void, not voidable. Article IV, Section 2 “Shall” is a mandatory term, not a discretional one.

"That's very different from saying a government employee has the right to not incriminate himself when being asked questions about depriving all of the American people of their basic rights. It's pretty obvious to see what a basic perversion that is."

If Trump can bypass the governor and activate the National Guard to put down protests on immigrant rights, he can do it to suppress your rights, too. If he can deploy the Marines to Los Angeles without justification, he can deploy them to your state, too. And if he can ignore due process, strip away first amendment rights, and disappear people to foreign prisons without their day in court, he can do it to you, too. Because California is just a test case for the rest of the country.

Today, I came to the Metropolitan Detention Center to exercise my constitutional rights as a Member of Congress to check on the safety and conditions of SEIU California President David Huerta, who was arrested by ICE. I pled with the National Guard, which was heavily armed, not to use their weapons against peaceful demonstrators who were simply exercising their rights to freedom of speech and protest. All people deserve to be treated with dignity and due process under the law. Peaceful, nonviolent demonstrations are critical to protecting our constitutional rights!
