The pro-caliphate legal and historical revisionists have misled many Muslims to imagine that a proper Islamic government resembles a confederated western democracy of sorts. According to one thesis: islamic governance cannot be reconciled with the modern state Arab and Muslim states are unislamic and unethical But a Muslim led confederate polity governed by islamic ethics and modeled in accord with western democracy must be established. If the current situation in Muslims lands is unislamic and unethical, how much different is the situation today from previous centuries of Muslim rule which serve as analogues for what we call “Khilafah”? Were the Umayyad, Abassid, Buyid, Safavid, Seljuk, Fatimid, and Mogul dynasties periods of khilafah or unislamic non-khilafah? If dynastic authoritarian rule along with the centralization of state power determines the immorality and non-islamicity of a polity’s governance, to what extent would have an authentic khilafah ever existed? Historical Islamic governance has not supported popular democracy. Those charged with selecting a Khalifah was a small group of elders/representatives during the early period but eventually evolved into dynastic/monarchical rule. The Ottoman Empire—often celebrated as a great Caliphate—was not a popular democracy. So those who delegitimize Muslim monarchies are clearly applying a double standard. Some of the most vocal proponents of neo-caliphism also leave out the fact that while Islam promotes meritocratic succession rather than nepotistic hereditary rule, with respect to religious orthodoxy only a Qurashite qualifies for khalifah. Last year, Mayor Abdullah Hammoud told a Christian resident he was “not welcome” in the city and said he would throw a parade the day that man left. Now local Christian pastors are publicly standing with the same mayor and framing outside concern as hate. Classical Islamic law is clear about the status of Christians under Muslim rule: pay the jizya tax, accept second-class legal status, and live with restrictions on churches and public criticism of Islam. Western liberalism keeps treating this as a personality issue instead of a civilizational one.

I was offended by the fact that he was asked by a voter why is the government involved in women's basic rights, and he answered with saying, I think it's great, for 52 years all of the legal scholars, the best legal scholars, Democrats, Republicans, both of them have wanted to get rid of it. And that's what I have done here. That is not at all how the legal scholars feel or how the American populace feels. And to the questions about lowering the prices of things, again, no real answer. I'm glad I know more about how donuts are made or whatever was going on there, but I don't think anyone walked away from that thinking that he had any sort of empathy for what is going on in women's lives all over the country.

For too long, we have been distracted by reductive debates about whether the blasphemy law is “Islamic” or not, ignoring the actual substance of the law, its reasoning, its motivations, its genealogy, all of which are colonial impositions that have radically disfigured our tradition. It is time to create our own field of conversation, to open up public discourse. This episode makes the case that Pakistan’s blasphemy law is a bidʿah, an (colonial) innovation that transformed the way theological difference has historically been expressed, debated and adjudicated among Muslims. This bidʿah has replaced centuries of legal reasoning with a model based on individual “hurt sentiment”; a concept entirely foreign to classical jurisprudence. “Blasphemy” is no longer judged based on the meaning and intent of something; it has become a matter of how offended someone feels. This episode travels back a few hundred years and compares two cases of intra-Muslim conflict that involved “majrooh jazbaat” (wounded sentiments), demonstrating that where once ikhtilāf was a rehmat for the ummah, the colonial project has turned it into a lanat. #talkabout295C

Under Sharia, women are not considered human beings with rights, they are property owned by men. The same laws permit child marriage, forced marriage, the enslavement of non-Muslim women as sex slaves, and the legal murder of any non-Muslim who refuses to submit to Islam. This is not a “personal belief.” This is a direct demand to replace British law, British freedom and British values with the barbaric 7th-century rule of Sharia. Not all cultures are equal.
