Holder: The Supreme Court is a broken institution. And it’s something that has to be part of the national conversation in ’26 and in ’28. If there is a Democratic trifecta in 2028—and I think the possibility of that is pretty good—Supreme Court reform has to be on the table. Term limits, at a minimum, and potentially expanding the Court are things that should be seriously considered. We cannot leave in place, without at least a discussion—and I think without substantive reforms being implemented—the Supreme Court as it is presently constituted.

Overall, this was a very good term for the Supreme Court. President Trump's most consequential accomplishment of his first term was the transformation of the Supreme Court to the first constitutionalist majority in ninety years. As a result, the Supreme Court ruled 6-3 that states can regulate trans surgeries on minors. And this week, the Supreme Court also ruled 6-3 that these nationwide injunctions by activist judges are unconstitutional. We may never know what’s going on in the heads of the three justices that decided to dissent from these commonsense issues.
