UgandaVsMollyKatanga Prosecution Case Enters Final Stretch There’s an air of nervous excitement in the Criminal Division of the High Court as this murder trial presided over by Lady Justice Rosette Comfort Kania enters its final stretch. Well, at least the prosecution case, that is. Last week, the defense finalized cross examination of PW23 and the prosecution also did a quick re-exam that barely lasted three hours. (We shall bring you a comprehensive report of PW23’s 5-weeks court appearance). Background For context, it might help to know that PW23’s testimony had several contested issues and it’s these, it appears, that compelled the Judge to task the prosecution to summon the next two witnesses. One such issue was on the blood splatter analysis. At the tail end of her evidence-in-chief, PW23, DSP Bibiana Akong told court that Charles Otai, the medical officer who rushed to the scene to offer first aid, came with a bag, which according to her contained blood. It is this blood that she suspects was splashed allover the couple’s bedroom to create an impression that Mrs Katanga had been violently beaten by her husband and her blood splashed allover the room, including the ceiling. The defense took serious issue with this and pointed to a blood splatter analysis report which, according to them, indicated that there had been violence in the room and from the police experts’ analysis, it is this violence that led to the spilling and splashing of blood allover the room. PW23 initially said she didn’t know about the report. When pressed, she said she knew about it but hadn’t read it. Attempts by the defense to have her read it and be cross examined on it were met with fierce objections from the prosecution. They said that while she was in charge of the investigation and thus the custodian of the file, she wasn’t an expert in blood splatter analysis and therefore couldn’t be cross-examined on the report. The defense, seemingly exasperated, said the prosecution was surpressing evidence. Mr Peter Kabatsi, a former DPP in two countries (you read that right), at one point stood up and told Chief State Prosecutor Jonathan Muwaganya that suppressing evidence was fatal to a criminal trial. Anyway, the presiding Judge in her wisdom called both sides to order and said court was inviting the blood splatter analysis expert as court witness and both sides were welcome to ask questions. The prosecution then said the defense was jumping the gun and in fact, they were going to invite the witness and if they didn’t, the defense was at liberty to invite them. The second issue seems to have been on the lack of alignment of evidence given by PW23 with a statement that another police officer who worked under her, Detective David Beteise, made. This was on whether fingerprints and nail clippings were ever taken from the late Henry Katanga. PW23 said these were never taken. The defense seemed to suggest that they were taken, tested and the results didn’t favor the prosecution’s case so they were never reported. According to defense attorney, MacDusman Kabega, Mr Beteise’s statement and the pathologist’s report indicate that these fingerprints were taken not only at the Katanga residence before taking the body to the mortuary but that they were also taken at the mortuary. Accusations of evidence suppressing flew around. They were settled with the promise that Detective Beteise was to be called. Anyway, after re-exam, court went into some house keeping. Initially, the Judge had indicated she was to go on leave and the prosecution said they wouldn’t be available for the whole of December because they were taking leave. Justice Kania asked Mr Muwaganya as to how many witnesses they had left. He answered: “2 to 4 but in any case, not more than 4.” The judge came back to them and said she had reconsidered her leave and implored both sides to try and close one side of the case before end of year. While some understand her decision to be fateful to her religious doctrine. Others argued that, her life should be more important than the religious belief. And many used this as reference to argue why and how religious has kept the country stagnant. Adding that, she lied that she was ready to do whatever the doctor said, that’s why people donated over ₦30M to her. That, if she’s so religious, why did she lie. Recall, in June about ₦4M was donated for her, all she had to do was show up at a facility and the entire ₦10M estimated bill would be sorted. Instead she opted for a local treatment in Calabar, where her religious beliefs won’t be violated. — It brought her right back to twitter. Apparently, Jehovah’s Witness forbids blood transfusions. Essentially because in the Old Testament God told the Israelites not to eat blood because it is sacred. Leviticus 17:10–14 “God commanded Israel not to consume blood because “the life of the flesh is in the blood.” And Acts 15:28–29 “Abstain from blood.” And Genesis 9:4 “Do not eat flesh with its life, that is, its blood.” In essence, they believe transfusing blood = consuming blood, just through the veins instead of the mouth. And it’s a disobedient to God and a moral sin. This policy was introduced in 1945 by the Watch Tower Bible and Tract Society. But it didn’t forbid blood transfusions. Until 1950’s when the church banned blood totally and then 1961 when they officially made blood transfusion a punishable offense. — disfellowship, ostracism, expulsion from the church. Academic scholars of the JW belief, have punished several researches that strongly argued why the doctrine is valid. Jehovah Witness also believes only 144,000 people will make heaven. They believe the world entered end time since 1914. Also, Jehovah Witness are also not allowed to join the Military, vote and celebrate Christmas. I remember when I was young, around 10-11 years old. My parents were both asleep as was my brother. I heard a knock on the back door which was weird because who uses the back door at a stranger’s house? The kitchen window was close by so I take a look. It looked like a teenager but hard to tell because they had a hoodie with the hood up. I didn’t open the door but I did crack the window and asked them what they wanted. They replied they were lost and wanted to come in to warm up and use the phone. Even when it’s daylight I know never to let anybody in period that I didn’t know, but a stranger after midnight was weird enough. I said no because I didn’t know them. Then they said that hey knew my dad and that’s why he came by. I said that’s fine and all but I’m not letting you use our phone. This was before cellphones were widely used, we had a landline like most people. The person wouldn’t take no for an answer and I could sense he was getting angry. I went and woke up my dad, I told him there was somebody at the back door and that he said they knew him. He walked to the door and looked out and said he didn’t know him. But he did talk through the door and told him that he was calling the police and that he should just leave. The person just stood there until the police finally came and even they asked him what he was doing knocking on the door at that hour. He told them he was lost and thought this was a house of a family friend. The police told him my dad didn’t know him and made him leave. So was this a case of wrong house or was he up to something. It makes me still wonder to this day but I’m still glad I never opened the door.

UgandaVsMollyKatanga Injuries Suffered by Mrs Molly Katanga Were Defense Injuries: Says One of East Africa’s Leading Orthopedic Surgeons Yesterday’s court session was marked by bitter exchanges between both sets of lawyers, accusations of witness intimidation and threats by a state attorney and an impromptu walkout by the presiding Judge who had visibly had enough of the bitter exchanges before her. But that was all after the defense’s second expert witness, an Orthopedic and Trauma Surgeon, Associate Professor and Researcher, told Justice Rosette Comfort Kania that before her was a woman who had likely suffered domestic violence and whose injuries were “pathognomonic of defense injuries”. That difficult “p word” being medical speak for “specifically characteristic or indicative of a particular disease or condition”. In this case, he explained that “when someone is facing you and trying to hit you, the natural reaction is to cover the sensitive parts like the eyes and face. The natural defense position that people take is to try to hide their face as much as possible.” He continued: “The reason we call them defense injuries is that these are injuries acquired when someone is trying to defend themselves.” While referencing Mrs Katanga’s injuries and deep tissue bleeding, he’d earlier described, he told Justice Kania, who was staring right at him that; “the reason I call them pathognomonic (very strongly suggestive) of defense injuries is that all the ecchymosis were on the ulnar side of the forearm and the hands which you usually put on the head as someone is trying to assault you.” The witness-who by the Judge’s witness protection order, we can only refer to as DW3XXX-stood in the witness stand at just after 10:20 am, spoke with the calm, confident authority of a man who has practiced at the top of his orthopedic surgery craft for 23 years! He told Judge Kania that on the morning of 2nd November 2023, he was called to attend to an emergency. This was at IHK. He saw a lady whose head was covered in heavy bandages. She was under the care of a neurosurgeon. He was “called to asses her upper limbs”. These he said are “the arms, the forearms and the hands”. Asked what he observed by Mrs Katanga’s defense attorney, Mr Elison Karuhanga (EK), DW3XXX said: “she had injuries on the palm, fingers, wrist area and on the forearm”. These injuries were on both sides; the left and right fore limbs. EK: Did you observe any other injuries? DW3XXX: I said she had a heavy bandage on the head. EK: So, Doctor, after you assessed her injuries, what did you do? DW3: We agreed with my colleagues that the patient should as urgently as possible be taken to theater for management of the injuries that she had. EK: was there an order in which you (different sets of specialists) would work on her? DW3: because of the urgency of the bleeding on the scalp that I came to understand, that bleeding was the most urgent. So, the first part was for him (the neurosurgeon) to arrest the bleeding on the scalp, stitch the wounds then I come in to perform a procedure on the upper limbs. EK: can you tell this court about the surgery you performed? DW3: you don’t want to know about the diagnosis I made before I go to the surgery? EK: please tell us the diagnosis DW3: in medicine, in order for us to come to the conclusion of what injuries the patient has got, we inspect, we palpate. Then after assessing, we do X-rays to see the status of the bones and joints. Mr Muwaganya: My Lord, is he giving us hypothetical scenarios or is he telling us what he did? DW3: I’m telling you what I did and how I make my decisions as a professional. He then said with the help of X-rays and theater assessment after the (blood) soiled dressings had been removed he assessed her injuries. In a report to Dr Moses Byaruhanga, he noted that Mrs Katanga presented with scalp bleeding and lacerations, painful wrists and hands following domestic violence. Injuries found were 👇🏾

Back at the pizza shop for whatever reason we always only had teenagers apply so most of my workers were all high school kids. There was this one 16 year old girl who was working there who is as entitled as can be. Anytime she made a mistake and it was brought to her attention, she would call her dad and her dad would come up to the shop to defend her. On this day we were short a driver so I was helping out delivering pizzas while I had the employees tend to the store. The 16 year old girl was trying to joke around and be funny, she through a dough ball at someone and it got stuck in their hair. Almost like gum it was a pain to remove. So that person in turn through a tomato at her and it splattered all over her clothes. She immediately got red in the face and started to cry. She had already clocked out and left when I got back from a delivery. About 5 minutes later her dad shows up and berates me for letting that happen to his daughter. I check the cameras and saw what happened and I even showed it to him but he still feels it was wrong for a tomato to be thrown at her so told him she started it and the other girl with the dough in her hair had to get some of it cut off. I acknowledged that both parties were equally wrong for participating in it but I wasn’t going to fire the girl who threw the tomato as she was responding to doing being thrown in her hair. He wasn’t exactly reasonable in response to my actions so I ended up banning him from the store.

UgandaVsMollyKatanga Senior Forensic Pathologist calls the possibility that Mr Henry Katanga was shot and killed by his wife Molly Katanga, “extremely slim and highly unlikely”. He said the case before Justice Rosette Comfort Kania is not a homicide but a homicide-suicide where Mr Henry Katanga beat his wife, thought she was dead then sat or stood on the bed and shot himself. He lambasted the postmortem report presented by the state to back up their case as a “very dangerous postmortem report that couldn’t have passed peer review” in a serious entity. Dr Sylvester Onzivua was the first defense witness in this trial. He holds a Degree in Medicine and Surgery, from Makerere University (1993), a Masters of Medicine in Pathology (2003), a Post Graduate Diploma in Forensic medicine from the Colleges of Medicine of South Africa (2005). He’s also trained in Forensic Anthropology from Durban. He worked with Mulago Hospital, attached to the Department of Pathology of Makerere University and part of his deployment was in the City Mortuary where he was the Head of City Mortuary. He worked there from 2005 up to 2013. He said he has testified in numerous cases, mostly for the prosecution, including in the military courts. In a session whose start was marked by early heated exchanges between defense attorney Elison Karuhanga and Chief State Attorney Jonathan Muwaganya, Dr Onzivua took on the mantle of courtroom forensic pathology Prof, basically reliving a teaching role he continues to play in real life at Makerere University, even after his retirement. Early court proceedings were anything but smooth, with the Judge calling both sets of lawyers to her chambers for more than 2 hours because the state was adamant that Dr Onzivua shouldn’t use the postmortem report on court file but should instead use copies availed to him by the defense. On resumption and with a 50 slide PowerPoint presentation, Dr Onzivua took Justice Kania through the science of bullets and bullet injuries. He told her how to tell a bullet entry wound from an exit wound. He then used images of the late Henry Katanga, taken during postmortem, to show that the pathologists who conducted that postmortem wrote an erroneous report that misled the court to think the bullet that killed Mr Katanga went from left to right as opposed to what he said was a scientifically incontrovertible conclusion that the bullet direction was right to left. This point is very key because when Justice Kania put Mrs Katanga to her defense, she relied in part on prosecution evidence that claimed that Mr Katanga was shot on the left side of his head and since he was right handed, this would be very difficult. Dr Onzivua scoffed at that and using a combination of human props and postmortem images, he showed that indeed the state had it wrong; that it was scientifically wrong to conclude as they did. He pointed to the absence of tattooing, lacerations on the hole on the left side of Mr Katanga’s head and wondered why the state pathologists concluded that it was an entry hole despite showing all characteristics of an exit hole. He said there’s “no tattooing, no blackening, no muzzle imprint on a close contact bullet entry wound? So how, how, hoooow would they have called this an entry wound in the absence of blackening, tattooing or muzzle imprint? There’s no scientific basis of calling the wound on the left an entry wound.” “The wound on the right was stated to be 5cm by 3cm and this was described as an exit wound. The entire dimensions of the ear were taken and then stated to be the dimensions of the exit wound. This, scientifically is not correct. The true dimensions of the skull defect on the right side were not taken and there is therefore no scientific basis to call it an exit wound. A comparison of the right and left ear shows blackening on the right and none on the left. On the contrary, the external features of the wound on the right side are those of an entry hole” Cont’d…

My neighbor always walks the dog at all hours of the day, rain or shine. She has a huge dog she can’t control, it actually walks her most of the time. This guy here has no excuse letting his dog on a leash get away, that thing is tiny. Yet he thinks it’s the man’s fault that his dog got nudged. What would you do if your neighbors dog got loose and they blamed your dog reacting to it, he needs to get his dog under control and get a life. Anyways, the neighbor with the big dog was walking her dog and it got away from her and ran into the street. Another neighbor was coming home from work and didn’t have time to react to it, she ended up hitting the dog causing a good amount of damage to her car and scuffing up the dog pretty good. The lady walking her dog had a fit of course and blamed the neighbor for hitting her dog. The neighbor retorted that she wouldn’t have hit it if the lady had it under control and isn’t run into the street. The lady ended up calling the cops, the cops came and cleared the neighbor of wrong doing. There were plenty of witnesses that saw it and we all see the dog pulling her all the time anyways. After the accident we didn’t see the lady walking her dog much anymore, her oldest son would do it most of the time to his annoyance but it was a better thing, he could control it where as his mother could not. I didn’t want to involve myself in their argument but I did tell the lady it was her fault, and that she needs to pay for the other neighbors car. Up until that point she was refusing to cooperate much. I never did ask if she paid but I have a feeling she did, the neighbor can be quite convincing when she needs to be.

This was really the sixth Pfizer shot, caused her cancer to come back and the spike protein was in there, which means that there had been integration, into what became her cancer cells, her recurrent cancer cells. "We have another case that's been published in the past month, literally within days of this Japanese case. It was a 31-year-old woman who had three Moderna vaccines and developed an aggressive bladder tumor. The bladder tumor was genetically sequenced and the researchers found that it contained an exact match, a genetic sequence that was an exact match for the Pfizer vaccine. "Now it's interesting, she had the Moderna vaccines, they found a match for the Pfizer vaccine, but there are sequences that are the same in both vaccines. And they also did further genetic testing and they found that she had all kinds of genetic, instabilities and damage that had arisen after she had taken these three mRNA vaccines.
