Adv Ngcukaitobi on the killing of 16-year-old Kwazi Ndlovu: 1. Kwazi was killed by high-velocity bullets that exploded inside his body while he was sleeping on a couch at home. 2. Kwazi was killed by Warrant Officer Gonasagren Padayachee, a member of Johan Booysen’s Cato Manor Hit Squad, who claimed that Kwazi was a criminal who shot at police. He was acquitted. 3. Kwazi’s funeral policy refused to pay out after police classified him as a criminal. 4. Kwazi’s parents lodged a complaint with Adv Shamila Batohi, that NPA prosecutor Adv Sandesh Sankar deliberately botched the case in the following manner: a) Adv Sankar moved the case from Empangeni (where the family lives) to Durban on the basis that an experienced magistrate was required, yet it was heard by an acting magistrate. b) Adv Sankar claimed to have consulted pathologist Dr Steve Naidoo and ballistic expert Cobus Steyl, whose reports were said to be inconclusive. c) Adv Sankar did not consider Captain Christian Mangena’s ballistic report in the docket, which concluded that Kwazi was shot while lying on a couch making it impossible for him to have fired at police. d) Very few witnesses were called or properly cross-examined. e) Adv Sankar was forcing the parents to settle for an inquest instead of a prosecution. Adv Batohi say she referred the complaint to KZN DPP Adv Elaine Harrison, who found no improper conduct, and Adv Batohi did not institute an independent investigation.

Unlawful Detention of BYC Leaders and Denial of Access to Families and Legal Counsel Constitute Grave Human Rights Violations On June 8th, leaders of the Baloch Yakjehti Committee (BYC) were unlawfully transferred from Hudda District Prison in Quetta to the Civil Lines Police Station on a 10-day remand. Since their transfer, they have not been seen, and authorities have denied access to both their families and legal counsel. This complete lack of transparency has raised serious concerns about their safety, including fears of potential torture in custody. In response, the families of the detained leaders gathered in front of the Civil Lines Police Station to demand their legal and moral right to visit their loved ones. The Superintendent of Police informed them that no meetings would be permitted without a court order. However, even after obtaining the necessary court directives, police have continued to deny access. Only the mothers of Dr. Mahrang Baloch and Beebow Baloch have been granted brief visits, while all other family members and legal representatives remain barred. In protest against these illegal and authoritarian actions, the families have initiated a peaceful sit-in outside the Civil Lines Police Station. We urgently call on national and international human rights organizations to intervene and hold the responsible authorities accountable. The state’s unconstitutional actions and continued targeting of human rights defenders must not go unchecked. Immediate attention and action are imperative to safeguard the rights and wellbeing of the detained BYC leaders. #ReleaseBYCLeaders

This outcome of the court proceedings and the historic judgment delivered by the Hon’ble Madhya Pradesh High Court would remain incomplete if we do not acknowledge the immense groundwork, dedication, and tireless efforts put in by several individuals even before the commencement of the legal proceedings. Adv. Virendra Ichalkaranjikar Ji (Ichalkaranjikar V.S.) from Hindu Vidhigya Parishad, along with Hindu Janajagruti Samiti (HinduJagrutiOrg), worked tirelessly with Shri Naval Kishore Ji, former Sangh Pracharak and a leading force behind the Bhojshala Mukti Andolan. Their collective efforts played a crucial role in keeping this issue alive at the national level and in building the foundation for the legal battle. Adv. Virendra Ichalkaranjikar Ji made extraordinary efforts by continuously sitting for eight days in the ASI Office at Bhopal and gathering all the relevant documents through RTI applications and detailed research. Those documents played a very significant role in bringing the true facts before the Court. The efforts of Sudarshan News and Shri Suresh Chavhanke Ji (Dr. Suresh Chavhanke “Sudarshan News”) are also highly commendable. They had been consistently raising their voice on the Bhojshala issue long before it became a mainstream subject of discussion. Their persistent efforts helped in creating nationwide awareness regarding the issue. The legal proceedings were then taken to their logical conclusion by Adv. Vishnu Shankar Jain Ji (Vishnu Shankar Jain) and Shri Hari Shankar Jain Ji (Hari Shankar Jain), whose relentless legal efforts and effective representation played a vital role in securing this historic result before the Hon’ble Court. This result is truly the outcome of collective efforts, unwavering dedication, and years of continuous struggle by numerous individuals and organizations.
