Democratic Rep. James Walkinshaw says a U.S. Postal Service whistleblower is raising “deep, deep concerns” about a new system for screening mail-in ballots, warning that if it takes effect, eligible voters could have their ballots rejected. Walkinshaw (D-VA) also tells Nancy Cordes USPS has not provided him with any “substantive answers” about its ability to implement the system ahead of the midterm elections.

Washington is back in court co-leading a lawsuit to defend our state’s safe and secure vote-by-mail system. On March 31, President Trump signed an unlawful executive order attempting to establish a national list of eligible voters and directing the U.S. Postal Service, an independent federal agency, to transmit mail ballots only to those on the list. But the President does not have authority to do that. The Constitution makes clear that states and Congress control how elections are run. Learn more here:

Postmaster General David Steiner told a Senate committee Wednesday that, if a proposed rule is adopted, the U.S. Postal Service would withhold mail ballots from states that do not hand over to the federal government lists of people who have requested absentee or mail ballots. Sen. Gary Peters, the top Democrat on the Senate Homeland Security Committee, asked Steiner if the Postal Service would deliver ballots to a state's voters if that state refuses to turn over its absentee voter roll. "Under our proposed regulation? No," Steiner said, adding that the Postal Service would "tell the state that we need the manifest." The proposed USPS rule will ask states to provide the agency with a list of people who have requested a mail-in or absentee ballot for an election. "This provision will help determine adherence to federal law and facilitate law enforcement efforts," the proposed rule states. The proposal cites President Donald Trump's March executive order that seeks to tighten mail voting rules and create eligible voter lists, even though the Constitution explicitly grants states the authority to run elections, while Congress has a limited oversight role in adopting election regulations. Despite the president's own use of mail ballots in past elections, he has called the voting method "cheating."

Under the proposal, states would need to collect basic voter information, such as a person's name and home address, and enter it into a federal ballot mail portal before it can be accepted by the mail service. The attorneys general allege the rule illegally interferes with their constitutional authority to administer elections because it allows the USPS to reject mail. "The president of the United States voted by mail," James said in an interview with NY1's Errol Louis (@errollouis.bsky.social). "It is safe, it's secure, it's been used by a number of states and we're too close to the midterm elections for them to implement this rule, and that's why we are in court again seeking an immediate temporary restraining order stopping this chaos and confusion."
