🚨In Key West, an ICE/Border Patrol agent threatened to PULL A U.S. CITIZEN OUT OF THE CAR because he cursed at an agent… then had the audacity to tell the U.S. citizen to “learn your laws.” So, let’s learn them. In the video, Border Patrol agents pulled over a car of U.S. citizens and demanded everyone hand over their IDs. When the passenger says, “Bitch, fuck you,” an agent asks what he said and then threatens to pull him out of the vehicle if he “says one more thing like that.” The passenger correctly asks: “For what? That’s freedom of speech.” The agent responds: “That’s not how that works. Learn your laws.” Oh, we’re going to… Cursing at a government agent is not, by itself, a crime. The First Amendment protects a significant amount of verbal criticism, insults, and profanity directed at law enforcement, as long as it is not a physical threat. The government cannot punish people simply for verbally challenging or criticizing law enforcement. And it gets even worse. After the passenger calls the agent a “fucking white cracker,” the agent asks what he called him… and then tells another agent he is “thinking of calling in and arresting this guy.” For what? Because he hurt your feelings? The government does not get to arrest someone for speech they don’t like. And yes, Border Patrol has special authority near the border. That includes operating immigration checkpoints where agents can briefly stop vehicles, without individualized reasonable suspicion, for immigration questioning. But, that is different from a roving patrol stop. When not operating at a checkpoint, Border Patrol needs reasonable suspicion to pull over a vehicle for immigration questioning. And even at a checkpoint, the agents’ authority is not unlimited. A checkpoint stop does not automatically give them the right to search the vehicle, indefinitely detain people, or arrest someone because they said something an agent didn’t like. The Constitution does not say… “You have freedom of speech, unless a federal agent gets offended.” It says the government cannot punish you for exercising that right. And perhaps the most important part of this entire video is… The passenger knew his rights better than the federal agent threatening him. The agent told the U.S. citizen to learn his laws… But maybe the agent should have learned them first.

🚨This video is terrifying, and it’s exactly why “just comply” does not protect you from ICE/Border Patrol agents, even as U.S. citizens, and why you always film them. In North Carolina, ICE/Border Patrol agents illegally stopped two U.S. citizens. They questioned them without legal cause, took their licenses, and admitted on camera that the men were allowed to record. And they were still attacked. In the video, one man asks if he can film for his safety. The agent says yes, saying that he’ll “have to put his mask on.” The agents take their licenses, ask where they’re from, where they live, what they’re doing in the area, all without legal authority. The men cooperate anyway. Then the situation turns dangerous. Another agent suddenly tells the driver, “Turn off your video. You are being detained, so you are not free to record.” That is false. Recording law enforcement in public is legal, including during detention. The driver calmly refuses, keeps one hand on the steering wheel as instructed, and holds his phone in the other. That’s when the agent lunges for the phone. The agent throws himself into the car, trying to grab the device. When the driver moves it away, the agent assaults him. The agent then illegally opens the car door, something the driver correctly points out they are not allowed to do. The agents keep demanding the filming stop, as multiple agents keep reaching for the phone. Then they escalate again. They threaten arrest, grab the driver, and start hitting him and trying to drag him out of the car, even though he keeps saying, “We haven’t done anything wrong.” When they fail to pull him out, they back away, visibly angry. They turn on the passenger next. An agent grabs him, threatens handcuffs, and assaults him trying to force him out of the vehicle. When that doesn’t work, they start yelling conflicting commands, claiming the men are “interfering with an investigation.” An investigation into what? Their own illegal stop. At one point, an agent shouts that the men can’t interfere, while another tries… again… to grab the phone, almost certainly to stop or erase the recording. Only after all of this do the agents finally release them. Because they are U.S. citizens. Because the stop was illegal. And because the camera was still rolling. This is why you film ICE. This is why compliance doesn’t save you. This is why they hate cameras. If this hadn’t been recorded, this would be another lie in a report, another “resisting” accusation, another abuse buried and denied. Film them. Always.

HE’S NOT OUR GUY ANYWAY.” THEN WHY THE HELL DID YOU KEEP HARASSING HIM?! ICE cannot just stop or detain someone because they want to know where they were born. The Fourth Amendment protects people from unreasonable seizures, and ICE agents need reasonable suspicion to detain someone for immigration questioning. And if this was just a “voluntary conversation,” the man was free to walk away. Instead, the agent followed him, blocked him from working, repeatedly demanded his identity and birthplace, and continued confronting him AFTER he tried to walk away. And that should piss everyone off. Because this wasn’t about finding the person they were looking for… The agent admitted that he KNEW the man wasn’t their guy. But that didn’t stop the armed federal agent from following and harassing a U.S. citizen. ICE has databases. They can verify citizenship without badgering people. Agents often push this question because they want the person to slip up or panic. A “verbal admission” makes their job easy…even if it’s false. This is why they keep pressing even after hearing “I’m a citizen.” And why it is important to not answer their questions. 4. This is coercion, not procedure. Holding someone’s ID while interrogating them is not a routine check. It’s an unlawful seizure under the Fourth Amendment. 5. ICE’s own rules forbid racial profiling. Because the biggest threat to an ICE agent is someone who knows their rights.
