They both are, let's discuss their respective offenses DUDE WITH THE SF GIANTS HAT ON: 1) He's wearing a SF Giants hat 2) He physically assaults the dude with the camera DUDE WITH THE CAMERA 1) He discharges the pepper spray as Giants Hat dude is in the act of retreating. This is not a justifiable use of force in most states. Since this is probably in California, I know for a fact this isn't justifiable use of force in that state. CONCLUSION: They're both assholes, but Camera Dude committed the worse offense. He was not in imminent nor immediate danger of grievous bodily injury or harm and used force anyway. He should go to jail.

The obnoxious 1st Amendment camera dude was wrong if he was blocking the entrance, and the business owner was wrong for pushing the camera. The bigger AH is the guy using his camera to provoke people into punching him so he can sue them.

Blocking a business in order that customers cannot enter is a violation and the man with the camera should be arrested for spraying pepper spray in the store owners face.

You can’t block a thoroughfare or block a means of egress for fire code reasons & others. Them resisting a lawful command by the property owner he showed he was threatening his customers and empires lives if there were a fire. Then the pepper spray would show battery.
