The man pleads, “I’ll give you my ID!” An agent responds, “Right, right, right…” as they push him out the door and take him away without verifying who he is or checking his ID. Everything about this video is alarming… Law enforcement is not allowed to detain people arbitrarily. ICE agents must have legal authority to seize someone, and restrooms, inside private businesses, are non-public spaces. If ICE agents do not understand that they cannot just barge into a foreign consulate without permission, maybe they should start using too. The homeowner was watching it happen, through his Ring cameras, and repeatedly told the agents to get the off his property. But they refused… And caused approximately $30,000 in damage. And after this happened, agents continued terrorizing one of the wealthiest areas in Chicago, by tear gassing the entire street… which directly violated a court order. The Fourth Amendment protects against unreasonable searches and seizures… Your home, and the private area around it, are some of the most protected spaces under the Constitution. Federal agents need a warrant, consent, or a recognized exception… such as exigent circumstances or valid hot pursuit… to enter private property like this. According to the lawsuit, they had none of those things… No search warrant, no arrest warrant, no permission to enter, and no probable cause or reasonable suspicion that criminal activity was happening on this property. That is why the homeowner is saying their Fourth Amendment right was violated. The manager reportedly told them they could not just storm through the kitchen without judicial authorization. Because the Fourth Amendment is still a thing… even though ICE agents keep pretending it isn’t. Law enforcement cannot just search private areas of a business because they feel like it. A kitchen, in a restaurant, is not a public space. When agents do not have consent, exigent circumstances, or a valid warrant signed by a judge… then managers have every right to question that search. In the video, one agent walks directly up to the back door holding a gun, knocks, and yells “POLICE.” Another agent is standing nearby with his weapon pointed directly at the door. Then another agent walks towards the house, from the backyard, after appearing to be looking around the private property. At no point do they announce a warrant, or claim there is an emergency situation. Just federal agents with guns drawn… surrounding a home where kids live. Federal agents are NOT allowed to just enter private property, surround homes, and intimidate families without judicial authorization. A warrant is supposed to be signed by a judge, specifically describe the place being searched, and be presented when demanded. And unless there is an immediate threat to life or public safety, pointing guns at a residence during a nonviolent immigration operation can very quickly cross into excessive force territory under the Constitution. This is exactly why constitutional protections exist in the first place. Because if the government can creep through backyards with guns drawn, targeting homes without presenting warrants, while children are inside… then those rights stop meaning anything at all.

At no point do they announce a warrant, or claim there is an emergency situation. Just federal agents with guns drawn… surrounding a home where kids live. Federal agents are NOT allowed to just enter private property, surround homes, and intimidate families without judicial authorization. A warrant is supposed to be signed by a judge, specifically describe the place being searched, and be presented when demanded. And unless there is an immediate threat to life or public safety, pointing guns at a residence during a nonviolent immigration operation can very quickly cross into excessive force territory under the Constitution. This is exactly why constitutional protections exist in the first place. Because if the government can creep through backyards with guns drawn, targeting homes without presenting warrants, while children are inside… then those rights stop meaning anything at all.

🚨BREAKING: Border Patrol agents illegally smashed through the glass door of a locked auto body shop, without a warrant, to detain the shop owner and an employee, in West Valley City, Utah. Yes, agents are violating the Constitution all over the country, not just in Minnesota. I asked Virginia Gov. Abigail Spanberger’s office how exactly would ICE get a signed judicial warrant for illegal immigrants in the Fairfax County jail, like Abdul Jalloh, who is accused of murdering a Virginia mother. Spanberger’s office still has not responded. Earlier this week, Spanberger’s office said ICE should request a signed judicial warrant if they want Jalloh deported. Jonathan Fahey says that might sound reasonable, but isn’t reasonable, and that Spanberger is knowingly putting up roadblocks to prevent ICE from doing their job and deporting Jalloh, who has a lengthy violent criminal history. ICE says, “Section 287 of the Immigration and Nationality Act provides ICE officers the authority to arrest aliens without a judicial warrant. In fact, no judge in this country has the authority to issue a warrant for a civil immigration violation. Congress, by statute, vested this authorization solely to supervisory immigration officers. Local police officers don’t need a warrant when they encounter someone breaking the law in a public space, and the same holds true for ICE officers. Obstructing or otherwise interfering with an ICE arrest is a crime, and anyone involved may be subject to prosecution under federal law.”
