Michael Proctor attorney Daniel Moynihan’s opening statement, only reinforced my belief that Michael Proctor should’ve never been terminated, and Michael Proctor deserves his job back. DAVID YANNETTI: RULE 3.6 VIOLATION, EVIDENCE HE TOO WAS DIRECTING AIDAN KEARNEY'S PROPAGANDA As we've shown in the past, Aidan Kearney was at times copying and pasting Karen Read's disinformation regarding the case into his "reporting" as well as broadcasting it on his live shows. But it wasn't only Read. David Yannetti was also supplying material for Kearney which substantially affected public opinion on the case, a violation of Professional Rule 3.6. As shown in the text below on the left from David Yannetti to Aidan Kearney on 06/09/2023, Yannetti claimed the black box data from Karen Read's Lexus was "bullshit", that the CW was "guessing about the route", and that they had "nothing". On cue, in the video on the right, the next evening on 06/10/2023, Kearney did a 14 minute segment on the black box and used, almost verbatim Yannetti's assertion about the route, exchanging the word "guessing" for "presumption" and going so far as to say "Lally's got nothing." Even worse, a Motion to Prohibit Prejudicial ExtraJudicial Statements of Counsel had been filed by the CW and was docketed 06/09/2023 PRIOR to Yannetti's text. Perhaps David Yannetti should be worrying less about my "low cut blouses" and more about the consequences his own actions.

In a jaw dropping moment Attorney Alan Jackson asks Proctor: “How do you feel about him (Attorney Yannetti) now? He’s sitting right there” Shockingly, Proctor responds: “I still don’t care for him now!” ——————— Wow. What a classy, unbiased professional. What Yannetti explained tonight on Defense Diaries was basically a masterclass in trial strategy. Everyone wanted Proctor on that stand but the how matters. If the defense calls him, Brennan gets a free second closing argument disguised as cross-examination, walking Proctor through every “helpful” point with the witness nodding along. That’s not just risky, it’s handing the Commonwealth a megaphone. Instead, the defense played it clean. They used Proctor’s buddy to authenticate the texts. No theatrics, no backdoor second summation, just the evidence, Proctor’s own words without giving him the platform. It also shows how much the defense learned from Trial #1. They weren’t about to “over-try” the case again or take on burdens that aren’t theirs. Their job wasn’t to prove Karen’s innocence beyond all doubt it was to expose reasonable doubt in the Commonwealth’s case. And they did that without falling into traps.
