In just one year, 5.2 billion out of a budget of 8.6 billion — that is not even theft; it is looting. Californians were fed up with retail theft and passed Prop 36 in all 58 counties with nearly 70% voter approval. Instead of fully funding and implementing what voters demanded, state legislators drafted AB 2108 and created yet another diversion program: this time for retail theft offenders. Like mental health diversion, it offers another way to avoid jail time. Offenders even walk away without a conviction on their record. Even more surprising is that some of California’s largest retailers, along with the California Retailers Association, support the bill despite reporting billions of dollars in losses due to retail theft. Voters wanted meaningful consequences for retail theft offenders, but the state legislature moved in the opposite direction.

Last night, around 9:30pm, officers were dispatched to a theft in progress at a retail business in the Colonies. As officers arrived, the suspect exited through an emergency exit with a bag of loot and ran towards a waiting car. The getaway car saw the police car and bailed on their partner. The suspect then dropped the bag and started running. After a foot pursuit through the parking lot, the suspect was taken into custody. The suspect vehicle was able to avoid capture (for the time being), however, all $1,779.79 of the merchandise was recovered. The suspect, who is on parole for being a felon who possessed a firearm, was booked for grand theft, organized retail theft, conspiracy, and put on a parole hold.

On February 19, 2025 at 2:15 p.m., detectives from the Gaithersburg Police Department - Investigative Section and Street Crimes Unit were at the Lululemon in the 100 block of Crown Park Avenue working the retail theft detail when they observed four unknown females enter the business, split up, and bearhug multiple items. The four suspects then made their way to the door without paying. One suspect was apprehended at the door and the three others fled on foot. After a brief foot pursuit, the three other suspects were apprehended in the area of the Harris Teeter located in the 300 block of Copley Place. The four suspects stole over $10,000 worth of items from the business. During the course of the investigation, it was learned that the four suspects had also committed a felony theft over $1,500 at the Bath & Body Works in Germantown. The four suspects are also being charged with retail thefts that occurred earlier this year at the Lululemon, along with a theft at the Lenscrafters located in the unit block of Grand Corner Avenue in Gaithersburg, MD. Herndon, Stewart, and Spivey were transported to the Montgomery County Detention Center and the 17-year-old was released to their parents. Why is Nevada starting to see retail theft crime similar to California’s? In 2019, the Democrat controlled Nevada legislature passed AB 236, a criminal justice reform bill, that upped the threshold for felony theft from $650 worth of stolen goods to $1,200. That is even HIGHER than California’s felony threshold of $950. 😧 Unfortunately, it doesn’t appear that any of the local media has reported about this incident yet. That's unacceptable. — Unfortunately, through the biggest tax increase in Washington state's history, despite the attempts and and claims that it's gonna hit wealthy Washingtonians, a big business, it's just not true. It's gonna hit regular people and your cost of housing, fuel, gas, groceries, health care, all gonna go up, unfortunately.
