In Trial 1, Trooper Proctor testified that MSP obtained John’s phone after going to Good Samaritan Hospital, and we know the next stop was Dighton, and then returning to Canton PD. That would place the phone’s retrieval after 5:30 PM, once they arrived at CPD at 5:31 PM, followed... by a 30–60 minute debrief with troopers who had been at 34 Fairview. In Trial 2 Trooper Yuri testified to something very different. He says he and Proctor walked into Canton PD together at 9:15 PM, met with Sean Goode and retrieved John’s phone at that time Same phone. Same department. Two trials. Two completely different timelines. So which is it? Retrieved early evening after Good Sam? Or retrieved at 9:15 PM after a sit-down at CPD? Because both can’t be true but one has to be. Lank met with Jen McCabe later that morning and she had her “Did I hit him?” recollection. He also makes a call to Gallagher after this meeting to put on the record the scene officers heard Karen say this, to which they all later testified they did not. Additionally, between 6:26:17am & 6:43:19am, John’s cellphone is logging steps throughout (365 steps total). Therefore, these data seem to eliminate the possibility that Kerry gave John’s phone to a firefighter/EMT given they were in the ambulance driving to the hospital during this time & wouldn’t have been able to have been walking around or climbing stairs. The flight of stairs is also shown as being climbed/ascended before John arrived at the hospital around 6:49am, per his hospital bracelet. This means that Kerry most likely gave John’s phone to a Canton Police Officer. However, the CPD Officers have testified that while some of them went inside 34 Fairview (in the foyer area), none of them went up or down any stairs at any point inside the house. This fact alone suggests that either Kerry’s memory is unreliable—and perhaps she gave the cellphone to Jen McCabe, for instance—or that the CPD Officer who she gave the phone to then gave the it to someone inside Brian Albert’s house who climbed a flight of stairs with it at 6:43:31am. Normally, this wouldn't be suspicious.. however, given the timeline of Goode being on his phone, it raises serious questions of who exactly he was speaking to and why. At 6:35:40 AM, Detective Sergeant Mike Lank gets a phone call that he says he does not remember who it was. This call lasts almost 3 mins. Immediately after he calls the Massachusetts State Police CPAC Unit for help. At 6:39:11 AM, the outdoor front light of 34FV is turned on and the door is opened. At 6:40:48 AM, Goode is seen texting after calling in a section 12 for Karen Read. We hear Goode tell Lank this while Lank is still on the phone with CPAC. Goode also asks if Lank wants to go inside because "the front door is actually open". While Lank and Goode head to the front door, Kerry Roberts and Karen Read return back. Within minutes, Karen is walked back to the ambulance and subsequently sent to the hospital for a section hold. They would draw her blood which then would be examined and given an estimate of her blood alcohol content of the time she supposedly ran into John O'Keefe. Goode and Lank would spend 18 minutes and 47 seconds inside 34 Fairview Rd with Brian Albert, Nicole Albert and Jen McCabe. While inside, Goode radios Kelly Dever in dispatch of the exact time of Jen's 911 call. Matt McCabe was also coming in and out (which was not testified to). Karen Read's defense team filed a motion today that included new video of Brian Higgins at CPD, which was withheld from them in the first trial. The surveillance video shows Brian Higgins pacing around outside, talking to someone on his phone at 1:34 AM. He NEVER mentioned speaking to anyone on the phone at the trial, or at the state or federal grand jury. Had he done so the defense could've filed a Rule 17 motion for his phone, which would be a lot stronger and less likely to be deemed a "fishing expedition" if they had video of him talking on the phone. He testified at trial that he was back home in West Roxbury by 1:40, and that it took 15-20 minutes to get there. This was all a lie, as was his excuse for being at CPD in the first place. This is a Brady violation.

Had he done so the defense could've filed a Rule 17 motion for his phone, which would be a lot stronger and less likely to be deemed a "fishing expedition" if they had video of him talking on the phone. He testified at trial that he was back home in West Roxbury by 1:40, and that it took 15-20 minutes to get there. This was all a lie, as was his excuse for being at CPD in the first place. Why is ADA Adam Lally so fixated on the time 8:22am, and specifically where Sergeant Yuri Bukhenik & Lead Investigator Michael Proctor were at 8:22am on January 29, 2022, and what they were doing at that time? Lally asks Bukhenik & Proctor: “Whereabouts were you at about 8:22 in the morning?” (see replies below) ——— BUKHENIK REPLIES: “At 8:22am, I would say I was still blowing the snow out of my driveway, clearing the path for my truck to leave the driveway.” ——— PROCTOR REPLIES: “Home.” LALLY ASKS: “Had you shoveled out of your driveway at that time?” PROCTOR REPLIES: “Not yet.” LALLY ASKS: “Um, had you cleaned off your car at that time?” PROCTOR REPLIES: “No.” ——— Lally then proceeds to ask both Yuri and Proctor about arriving at the Canton Police Department, who was there in the parking lot first, etc. ——— When ADA Lally was about to ask Bukhenik this oddly specific 8:22am whereabouts question, he initially starts out saying “And sir, when you arrived, so at approximately 8:22 in the morning or so…” almost as if he’d remembered he was supposed to get something important in about 8:22am BEFORE asking Yuri or Proctor about when they arrived at the Canton Police Department. We’ve never heard anything whatsoever about either 8:22am OR about Yuri or Proctor allegedly at home shoveling/snow blowing/removing. Additionally, having looked back at all of the known timestamp data and timeline pertaining to this case, there wasn’t anything I could find that happened at 8:22am on January 29, 2022. 8:22am is an oddly specific time. If ADA Lally simply wanted to establish that these guys had not yet shoveled out their driveways at that time, were shoveling their driveways at that time/after being notified around 6:40am but prior to going to the Canton Police Department, wouldn’t he be more broad/vague? “What were you doing around 8 or 8:30am?” for instance? Particularly given this was elicited during direct examination…in other words, asking a witness on direct what they were doing at 8:22am is semi-leading the witness with that specific timestamp. But also, isn’t it odd for these witnesses to know down to the minute that at 8:22am, that was precisely when they started shoveling out their driveways? Or whether they’d began shoveling out their driveways yet at that precise time or not? Wouldn’t the more natural response to that question be something along the lines of “I don’t remember exactly what time I began or finished shoveling, but it was the last thing I did before I left the house to go to CPD, and I know I arrived at CPD around 9am” for example? 8:22am is not a time that, based on prior testimony and evidence, holds any significance. But clearly, now it does. Why is that? Why was it of enough importance for Lally to remember he needed to establish that both of those witnesses were at their homes at that time, and not elsewhere? What’s interesting is that Lally asks Yuri what he was doing at 8:22am, and Yuri responds he was snow blowing then. But for Proctor, Lally asks where he was at 8:22am, to which Proctor simply replies “home”. Lally then follows up to ask Proctor if he’d begun shoveling or clearing off his car then, to which he says “not yet” and “no”. So clearly it was important to establish that both Yuri Bukhenik & Michael Proctor hadn’t shoveled out their driveways yet, hadn’t left their homes yet, and were nowhere else but their homes at 8:22am. Why does this matter? Also, if Yuri and Proctor were notified around 6:40am of a situation they’d have to respond to, why did they wait nearly 2 hours before beginning to shovel their driveways? I’m not saying it was an attempt at an alibi, but certainly it was significant enough for Lally to be sure to establish that at precisely that exact moment in time, Yuri & Proctor weren’t somewhere else. Lally asks Bukhenik & Proctor: “Whereabouts were you at about 8:22 in the morning?” (see replies below) ——— BUKHENIK REPLIES: “At 8:22am, I would say I was still blowing the snow out of my driveway, clearing the path for my truck to leave the driveway.” ——— PROCTOR REPLIES: “Home.” LALLY ASKS: “Had you shoveled out of your driveway at that time?” PROCTOR REPLIES: “Not yet.” LALLY ASKS: “Um, had you cleaned off your car at that time?” PROCTOR REPLIES: “No.” ——— Lally then proceeds to ask both Yuri and Proctor about arriving at the Canton Police Department, who was there in the parking lot first, etc. ——— When ADA Lally was about to ask Bukhenik this oddly specific 8:22am whereabouts question, he initially starts out saying “And sir, when you arrived, so at approximately 8:22 in the morning or so…” almost as if he’d remembered he was supposed to get something important in about 8:22am BEFORE asking Yuri or Proctor about when they arrived at the Canton Police Department. We’ve never heard anything whatsoever about either 8:22am OR about Yuri or Proctor allegedly at home shoveling/snow blowing/removing. Additionally, having looked back at all of the known timestamp data and timeline pertaining to this case, there wasn’t anything I could find that happened at 8:22am on January 29, 2022. 8:22am is an oddly specific time. If ADA Lally simply wanted to establish that these guys had not yet shoveled out their driveways at that time, were shoveling their driveways at that time/after being notified around 6:40am but prior to going to the Canton Police Department, wouldn’t he be more broad/vague? “What were you doing around 8 or 8:30am?” for instance? Particularly given this was elicited during direct examination…in other words, asking a witness on direct what they were doing at 8:22am is semi-leading the witness with that specific timestamp. But also, isn’t it odd for these witnesses to know down to the minute that at 8:22am, that was precisely when they started shoveling out their driveways? Or whether they’d began shoveling out their driveways yet at that precise time or not? Wouldn’t the more natural response to that question be something along the lines of “I don’t remember exactly what time I began or finished shoveling, but it was the last thing I did before I left the house to go to CPD, and I know I arrived at CPD around 9am” for example? 8:22am is not a time that, based on prior testimony and evidence, holds any significance. But clearly, now it does. Why is that? Why was it of enough importance for Lally to remember he needed to establish that both of those witnesses were at their homes at that time, and not elsewhere? What’s interesting is that Lally asks Yuri what he was doing at 8:22am, and Yuri responds he was snow blowing then. But for Proctor, Lally asks where he was at 8:22am, to which Proctor simply replies “home”. Lally then follows up to ask Proctor if he’d begun shoveling or clearing off his car then, to which he says “not yet” and “no”. So clearly it was important to establish that both Yuri Bukhenik & Michael Proctor hadn’t shoveled out their driveways yet, hadn’t left their homes yet, and were nowhere else but their homes at 8:22am. Why does this matter? Also, if Yuri and Proctor were notified around 6:40am of a situation they’d have to respond to, why did they wait nearly 2 hours before beginning to shovel their driveways? I’m not saying it was an attempt at an alibi, but certainly it was significant enough for Lally to be sure to establish that at precisely that exact moment in time, Yuri & Proctor weren’t somewhere else. Kelly Dever’s timeline raises an important question about how complete or incomplete the Canton PD movement logs actually are. At trial, Kelly testified she remained in her cruiser until Sgt. Goode summoned her inside to take over dispatch duty after the John O’Keefe 911 call. The movement logs appear to show that later that day at 1:29 PM she leaves the desk area, goes to the waiting area and corridor 104. In the 2nd trial she testified that her overtime shift ended around 3:45 PM At 3:47 PM she swipes into the female locker room on the 2nd floor.And then… nothing. No documented exit. No camera footage key swipe in any other area or out. Then later that SAME night on January 29 11:28 PM she gains access through rear entry to secure corridor, heads directly upstairs to the female locker room, then 2nd floor lobby corridor 227. Again, there are no other reported building-entry swipes associated with her movements. This doesn’t prove wrongdoing. But it absolutely raises questions about whether the access-control logs being discussed publicly are actually a complete reconstruction of movement inside Canton PD that day. Another thing that stands out from that day is the enormous volume of Sallyport to Booking Booking to Sallyport Comm to PED Sallyport Sallyport to Secure Corridor Sallyport to Front Exit Those dominate the logs. The rear-entry pathway appears relatively uncommon in comparison. What makes Kelly’s entry stand out is that she uses one of the less frequently logged access paths, immediately transitions upstairs to the female locker room,then corridor 227,with no additional visible building-entry sequence surrounding it. But then after video is shown? “Oh… it must’ve been later.” Trial 2? Different location. Different wording. Now it happened at Jen’s house on County Way. Sure. Why not. Then there’s the grand jury testimony where she painted a “very, very detailed picture” of Karen asking to Google hypothermia who was there, where she was standing, what everyone was doing. Under oath at trial? “I did not hear her ask that. I was told she was asked that.” So the “very detailed picture” was based on… secondhand information. Under penalty of perjury. No big deal.
